A brief outline of bankruptcy:

Bankruptcy allows a person to file a bankruptcy petition in Federal Court, discharge debts and get a fresh start in life.

The Procedure

The process begins with a petition in the Federal Bankruptcy Court listing assets, debts and describing your financial affairs. A trustee is appointed to oversee the process of distributing the assets.

Once a petition is filed, you obtain the benefit of an "automatic stay" of any proceedings against you. This immediately stops pending court actions, foreclosures, evictions, harassing telephone calls from creditors, utility shutoffs-virtually anything being done as a result of your financial problems. What you can save if you go bankrupt:

Even if you declare bankruptcy, there are certain items you are allowed to keep. These items are called exemptions.  Need to know more? Click here.

You are allowed to chose between Federal bankruptcy exemptions and State exemption. You can not mix and match, you must chose which of the two exemptions you like. The Federal exemptions are listed at http://www.berkshire.net/~mkb/bc522d.html. The Massachusetts State exemptions include a Homestead exemption, which as of November 2000 allows you to keep $300,000 in equity in your home. There is an excellent article on the Massachusetts Homestead law at http://www.lawlib.state.ma.us/homestead.html.  To learn more about Homesteads and to read our law firm article about exemptions, click here.
